1. Agreement and operator
These Terms of Service ("Terms") are a binding agreement between you and the individual sole operator of Stage Heat ("Stage Heat", "we", "us") for your use of the Stage Heat mobile apps, hosted web app at stageheat.app, and related API (together, the "Service"). By accessing or using the Service you accept these Terms. If you do not agree, do not use the Service.
Stage Heat helps concert-goers discover artists and shows, explore setlists and tour information, follow artists, export or sync playlists to connected streaming services, and—where available—submit bar or venue playlist proposals and manage tour notification preferences.
These Terms are provided for information. They do not replace professional legal advice about your specific situation.
2. Eligibility and accounts
You must be at least 13 years old (or 16 in jurisdictions that require a higher age for online consent) and able to form a binding contract. The Service uses Firebase Authentication. You may use a guest (anonymous) session or register with email. You are responsible for your credentials and for activity under your account.
Certain features—including Stage Heat Plus, connecting multiple streaming services, cross-platform sync, saving follows, and some notification settings—require a registered (non-guest) account and, where applicable, an active Plus entitlement.
You must provide accurate registration information and keep it up to date. We may suspend or close accounts that are inactive, fraudulent, or used in violation of these Terms.
3. Streaming services and OAuth
When you connect Spotify, Apple Music, YouTube, or other supported providers, you authorize Stage Heat to access your account through OAuth or provider SDKs only as needed to connect the service, read library or playlist data you request, and create or update playlists according to your actions in the app.
Your relationship with each streaming provider remains governed by that provider's terms and privacy policy. We do not control third-party platforms and are not responsible for their availability, policies, content moderation, or removal of tracks or videos.
You may disconnect a provider at any time in the app. Disconnecting stops new API access; previously exported playlists on the provider remain under that provider's rules.
4. Setlist, concert, and tour data
Setlist and show metadata may come from third-party sources including setlist.fm and Ticketmaster Discovery API (and related ticket links). That information is provided "as is" for discovery and planning. We do not guarantee accuracy, completeness, timing, or that any concert will occur as listed.
Ticket purchases, if any, are made directly with ticket sellers or venues; Stage Heat is not the ticket vendor unless we explicitly state otherwise for a specific offer.
Personal use of exported playlists is intended for your private enjoyment unless a streaming provider's terms require otherwise.
5. Discover, follows, and notifications
The Discover experience may show trending artists, nearby or upcoming shows, and artists you follow. Follow lists and preferences are stored with your account so we can personalize the Service.
If you enable tour or show notifications, we may send push messages (for example via Firebase Cloud Messaging when that feature is enabled on your device) or email according to your settings. You can change or turn off notification preferences in the app. Message and data rates may apply from your carrier.
6. Bar and venue playlist proposals
Stage Heat may let you suggest playlists for bars, venues, or other establishments ("Proposals"). A Proposal is a suggestion only—it does not create a contract between you and the venue, and venues may accept, ignore, or modify suggestions at their discretion.
Some Proposals may be reachable via public links (for example paths under /p/ on our web app) so venues or staff can review them. Do not include personal data you do not want shared on a public Proposal page.
Venues and bars—not Stage Heat—are responsible for obtaining and complying with public performance, mechanical, and other licenses required to play music in their premises. Stage Heat does not grant performance rights and is not a performing rights organization.
7. Stage Heat Plus and payments
Stage Heat Plus is a paid subscription that unlocks features such as connecting multiple streaming services and cross-platform playlist sync. Prices, billing intervals, and included features are shown at purchase and may change for new subscriptions with notice where required by law.
On the web, payments may be processed by Stripe. On mobile, purchases may be processed by the Apple App Store or Google Play. We receive subscription status and transaction references from those processors, not your full payment card details.
Subscriptions renew automatically until you cancel through the applicable store or billing portal before the renewal date. Stage Heat handles refunds. Contact legal@stageheat.app.
8. 14-day right of withdrawal
If you are a consumer subscribing to Stage Heat Plus, you have the right to withdraw from this contract within 14 days of subscribing without giving any reason.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by sending an unequivocal statement by email to legal@stageheat.app, or by using the model withdrawal form below. You may also cancel recurring renewal at any time in Manage billing.
Full refund within 14 days, no questions asked. If you exercise your right of withdrawal within 14 days of subscribing, you will receive a full refund of amounts paid.
We will reimburse you within 14 days of receiving your withdrawal request, using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement.
Model withdrawal form (TRLGDCU Annex B): To Stage Heat, legal@stageheat.app: I hereby give notice that I withdraw from my contract for the following service: Stage Heat Plus. Ordered on: ___. Name: ___. Email used for the account: ___. Date: ___.
9. Acceptable use
You agree not to misuse the Service, including by attempting to break security, scrape or overload our API, reverse engineer client software except where law permits, infringe intellectual property or privacy rights, harass others, or use the Service for unlawful purposes.
You may not misrepresent your identity, submit Proposals on behalf of a venue without authority, or use tour or setlist data to spam venues or users.
We may investigate violations and suspend or terminate access, remove content, or report activity to authorities when we reasonably believe it is necessary to protect the Service, users, or third parties.
10. Intellectual property
Stage Heat owns or licenses the Service, branding, software, and design. Setlists, artist names, and recordings remain subject to third-party rights. You receive a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
Feedback you send us may be used to improve the Service without obligation to you, subject to our Privacy Policy.
11. Service availability and changes
The Service is provided on an "as is" and "as available" basis. Our API and primary database run in Microsoft Azure, West Europe (WEU). Maintenance, upstream rate limits (including on setlist or ticket data providers), or outages at Firebase, Azure, or streaming partners may affect features temporarily.
We may add, change, or remove features. If we discontinue the Service materially, we will provide reasonable notice where practicable.
12. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT SETLISTS, SHOW DATES, OR PROPOSALS WILL BE ERROR-FREE OR THAT PLAYBACK AT A VENUE WILL OCCUR.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAGE HEAT AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO STAGE HEAT FOR PLUS IN THAT PERIOD OR (B) EUR 50 (OR USD 50 IF YOU PAID IN US DOLLARS), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER MANDATORY CONSUMER PROTECTION LAW.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.
13. Governing law and disputes
These Terms are governed by the laws of the country in which the operator is established, without regard to conflict-of-law rules. If you are a consumer in the European Union, European Economic Area, or United Kingdom, mandatory consumer protections in your country of residence apply and you may bring claims in your local courts where those laws allow.
If you are a business user, you agree that the courts of the country in which the operator is established have non-exclusive jurisdiction unless mandatory law provides otherwise.
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution before a consumer arbitration board unless required by law.
14. Changes to these Terms
We may update these Terms from time to time. We will post the revised version in the app and update the "Last updated" date. For material changes we will provide additional notice (for example in-app or by email) where required by law. Continued use after the effective date constitutes acceptance where permitted.
